In California, slip and fall lawsuits fall under a larger category of law known as premises liability law. To have a successful premises liability lawsuit, California law requires that the plaintiff is able to prove the following four elements:
- The defendant owned, leased, occupied, and/or controlled the property;
- The defendant was negligent in using or maintaining the property;
- The plaintiff was harmed; and
- The defendant’s negligence was a substantial factor in causing the plaintiff’s harm.
What makes a person negligent under the law? In Glendale, the law makes clear that a person has a basic duty of care when it comes to his or her property (whether she rents or owns it). That basic duty of care requirement means that a defendant can be negligent if she “fails to use reasonable care to keep the property in a reasonably safe condition.” The law also clarifies that property owners are required to “use reasonable care to discover any unsafe conditions and to repair, replace, or give adequate warning of anything that could be reasonably expected to harm others.”
In other words, a property owner has a duty to fix dangerous conditions or to warn people about those dangerous conditions. If a property owner fails to take either of these steps, then she may have failed to provide a basic duty of care and thus may be liable for injuries that result from the dangerous conditions on the property.
